The Lucknow Bench of the Allahabad High Court has granted time to the Uttar Pradesh Legislative Assembly Secretariat to file its response in a petition seeking the ouster of Pradeep Kumar Dubey, Principal Secretary of the Uttar Pradesh Legislative Assembly, from the post allegedly being held without lawful authority.
The matter was heard by a Division Bench comprising Justice Rajesh Singh Chauhan and Justice Divesh Chandra Samant in a writ petition filed by Karmesh Pratap Singh.
During the hearing, counsel appearing for the Uttar Pradesh Legislative Assembly Secretariat and the Speaker sought time to place their stand before the Court and raised objections regarding the maintainability of the petition. Accepting the request, the Bench granted time for filing a short counter affidavit and fixed the matter for further hearing on July 6, 2026.
The petitioner contended that Pradeep Kumar Dubey is continuing on the post of Principal Secretary, Uttar Pradesh Legislative Assembly, without legal authority and urged the Court to grant urgent relief. The Court, however, directed the respondents to file their response before considering the matter further.
The Bench noted that Dubey has been serving as Principal Secretary since 2012, while the petitioner claims that he was initially entrusted with the additional charge of the post in January 2009.
Significantly, the case was placed before the present Bench pursuant to a nomination order passed by the Chief Justice. Earlier, Justice Jaspreet Singh had recused himself from hearing the matter, following which it was assigned to the Division Bench headed by Justice Rajesh Singh Chauhan.
The petition has now been directed to be listed on July 6, 2026, for next hearing.
