In a significant judgment interpreting the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, the Delhi High Court has held that the right to file an appeal is not restricted only to senior citizens or parents, but is available to any affected or aggrieved person.

Justice Prathiba M. Singh delivered the judgment in Rakhi Sharma v. State & Others, while dealing with a challenge to an eviction order passed under the Senior Citizens Act.

Background of the Case

The petitioner, who was the daughter-in-law of a senior citizen, challenged an eviction order passed by the District Magistrate directing her eviction from the property of her mother-in-law under the provisions of the Senior Citizens Act and the Delhi Rules. The primary issue before the Court was whether an appeal against such an order could be filed only by a senior citizen or whether other affected persons could also avail the appellate remedy.

Court's Findings

The Delhi High Court observed that although Section 16 of the Act refers to an appeal by a senior citizen or parent, a restrictive interpretation would create an anomalous situation by denying a valuable right of appeal to the opposite party affected by the order.

Relying upon earlier decisions and the judgment of the Punjab & Haryana High Court in Paramjit Kumar Saroya v. Union of India, the Court held that the statute must be interpreted purposively and that the right of appeal extends to all affected parties, including children, relatives, daughters-in-law or any other person adversely affected by the order.

The Court specifically ruled that:

"Section 16(1) of the Act must be read as conferring a right of appeal on any affected party."

Clarification Regarding Eviction Proceedings

The Court further clarified that in eviction matters under Rule 22(3) of the Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, an appeal against the order of the Deputy Commissioner/District Magistrate lies before the Divisional Commissioner, Delhi.

Accordingly, the writ petition was permitted to be withdrawn with liberty to the petitioner to avail the statutory appellate remedy. The Court also protected the petitioner from immediate eviction until the appellate authority considered the application for interim relief.
