      इलाहाबाद हाईकोर्ट का महत्वपूर्ण फैसला: SC/ST Act के मामलों में Section 482 Cr.P.C. की शक्ति पर बड़ा स्पष्टीकरण

State of U.P. & Another, Application U/S 482 No. 8635 of 2023 एवं संबद्ध मामलों में इलाहाबाद हाईकोर्ट की Division Bench ने 26 नवंबर 2024 को Section 482 Cr.P.C. के तहत High Court की inherent jurisdiction और SC/ST (Prevention of Atrocities) Act, 1989 की Section 14-A के बीच संबंध पर महत्वपूर्ण प्रश्नों का उत्तर दिया। निर्णय में Neutral Citation 2024:AHC:185370-DB है।

      विवाद का मुख्य प्रश्न

      मामला मुख्यतः इस प्रश्न से संबंधित था कि जब किसी व्यक्ति के विरुद्ध SC/ST Act के अंतर्गत पूरी criminal proceedings चल रही हों, तो क्या वह Section 482 Cr.P.C. के तहत High Court का दरवाजा खटखटा सकता है, जबकि Section 14-A में appeal का statutory remedy उपलब्ध है।

      इस विषय पर Allahabad High Court के अलग-अलग Single Benches के निर्णयों में मतभेद सामने आया था। एक दृष्टिकोण के अनुसार Section 14-A के तहत appeal उपलब्ध होने पर Section 482 की application maintainable नहीं होगी, जबकि दूसरे दृष्टिकोण में Supreme Court के विभिन्न निर्णयों के आधार पर inherent jurisdiction के प्रयोग की संभावना स्वीकार की गई थी।

      Full Bench के निर्णय से अंतर

      Bench ने Ghulam Rasool Khan v. State of U.P. में दिए गए Full Bench के उत्तरों पर भी विचार किया। उस मामले में यह कहा गया था कि जहाँ Section 14-A के तहत appeal का remedy उपलब्ध है, वहाँ उस remedy को छोड़कर Section 482 Cr.P.C. की inherent jurisdiction का सहारा नहीं लिया जा सकता।

      लेकिन वर्तमान reference में प्रश्न अलग था—क्या पूरी criminal proceedings को ही challenge करने की स्थिति में Section 482 Cr.P.C. के तहत High Court की inherent jurisdiction उपलब्ध रहेगी। Bench ने इस प्रश्न को Ghulam Rasool Khan में तय किए गए प्रश्न से अलग माना।

      “Not Maintainable” और “Not Liable to be Entertained” में अंतर

      निर्णय का एक महत्वपूर्ण हिस्सा High Court द्वारा “not maintainable” और “not liable to be entertained” के बीच अंतर को स्पष्ट करता है।

      Court के अनुसार किसी proceeding का not maintainable होना यह दर्शाता है कि वह proceeding कानूनन लाई ही नहीं जा सकती, जबकि not liable to be entertained का अर्थ है कि application लाई जा सकती है, लेकिन particular facts and circumstances में Court उसे entertain न करे।

      इसलिए Section 482 के प्रत्येक मामले में यह देखा जाना आवश्यक है कि क्या proceedings को जारी रखना abuse of process of Court होगा अथवा justice के ends को सुरक्षित करने के लिए High Court का हस्तक्षेप आवश्यक है।

      Supreme Court के निर्णयों पर भरोसा

      Division Bench ने Hitesh Verma, Ramgopal, Ramawatar, B. Venkateswaran और Gulam Mustafa सहित Supreme Court के विभिन्न निर्णयों पर विचार किया। Bench ने कहा कि इन निर्णयों में Section 482 Cr.P.C. के संबंध में Supreme Court का दृष्टिकोण लगातार इस बात को मान्यता देता रहा है कि appropriate circumstances में abuse of process को रोकने और ends of justice सुरक्षित करने के लिए inherent jurisdiction का प्रयोग किया जा सकता है।

      विशेष रूप से Ramawatar v. State of Madhya Pradesh के संदर्भ में Court ने उल्लेख किया कि यदि SC/ST Act से संबंधित मामला वास्तव में निजी या civil nature का हो, alleged offence caste के कारण committed न हुआ हो, अथवा proceedings जारी रखना abuse of process हो, तो appropriate circumstances में High Court Section 482 के तहत हस्तक्षेप कर सकता है।

      Compromise के मामलों में भी Section 482 की भूमिका

      निर्णय में Supreme Court के Gian Singh v. State of Punjab के principles का भी उल्लेख किया गया। इसमें inherent power और statutory compounding power के बीच अंतर बताया गया है। High Court की Section 482 jurisdiction का उद्देश्य केवल offences compound करना नहीं बल्कि, परिस्थितियों के अनुसार, ends of justice secure करना और abuse of process रोकना है।

      Court ने यह भी नोट किया कि कुछ criminal proceedings में dispute का मूल स्वरूप निजी या civil हो सकता है और ऐसी परिस्थितियों में, applicable legal principles के अधीन, compromise के आधार पर Section 482 की jurisdiction का प्रश्न अलग तरीके से विचार किया जा सकता है।

      हाईकोर्ट के अंतिम निष्कर्ष

      Division Bench ने स्पष्ट किया कि Section 14-A SC/ST Act में appeal का remedy उपलब्ध होना अपने-आप में प्रत्येक मामले में Section 482 Cr.P.C. की jurisdiction को समाप्त नहीं करता।

      Bench ने प्रश्न संख्या 1 का उत्तर देते हुए कहा कि High Court की inherent jurisdiction के संबंध में कोई hard-and-fast rule नहीं बनाया जा सकता। यदि किसी particular case में interference से law या Court की process के misuse/abuse को रोका जा सकता है, तो High Court हस्तक्षेप कर सकता है।

      सबसे महत्वपूर्ण रूप से, जब SC/ST Act के अंतर्गत पूरी proceedings को challenge किया गया हो, तो High Court justice के ends को secure करने के लिए Section 482 Cr.P.C. की inherent jurisdiction में उस matter को entertain कर सकता है।

      वहीं, यदि पूरी proceedings Section 482 के तहत challenge नहीं की गई हैं और केवल किसी particular order, जैसे summoning order, को चुनौती दी जा रही है, तो Section 14-A SC/ST Act के तहत उपलब्ध appellate remedy महत्वपूर्ण हो जाती है। Bench ने कहा कि ऐसे मामले में accused/applicant के लिए Section 14-A के तहत appeal का रास्ता उपलब्ध है।

      निष्कर्ष

      Abhishek Awasthi @ Bholu Awasthi का यह निर्णय Section 482 Cr.P.C. और Section 14-A SC/ST Act के बीच jurisdictional relationship को समझने के लिए महत्वपूर्ण है। निर्णय यह स्पष्ट करता है कि statutory appeal की उपलब्धता को केवल mechanical तरीके से देखकर Section 482 की inherent jurisdiction को हर परिस्थिति में समाप्त नहीं माना जा सकता। Court को मामले के वास्तविक facts, abuse of process और ends of justice के संदर्भ में jurisdiction के प्रयोग का प्रश्न तय करना होगा।
