      मुख्य तथ्य

      Applicants ने Case (Session) No. 1149 of 2026, State Vs. Sooraj Yadav & Ors. की proceedings को quash करने की मांग की थी। यह मामला Special Judge (SC-ST Act), Lucknow के समक्ष लंबित था। Applicants ने Cognizance-cum-Summoning Order dated 10.06.2026 तथा Chargesheet dated 09.09.2025 को भी चुनौती दी। Chargesheet में Sections 115(2), 352 BNS तथा Sections 3(2)(va), 3(1)(dha) SC/ST Act लगाए गए थे।

      Applicants की ओर से मुख्य तर्क यह था कि FIR में alleged victim को जाति के नाम से गाली देने या caste-based abuse करने का कोई आरोप नहीं है। इसलिए SC/ST Act के आवश्यक ingredients prima facie attract नहीं होते। यह भी तर्क दिया गया कि intent to insult मौजूद नहीं है और Keshaw Mahto v. State of Bihar, 2026 SCC OnLine SC 799 के निर्णय का लाभ applicants को मिलता है।

      हाईकोर्ट की महत्वपूर्ण टिप्पणी

      High Court ने दोनों पक्षों की submissions पर विचार करते हुए कहा कि “intent of insult is missing”, क्योंकि caste का नाम लेकर abuse किए जाने का आरोप नहीं है। Court ने यह भी नोट किया कि applicants ने malice का plea लिया है और उनका मामला prima facie Keshaw Mahto के ratio से covered दिखाई देता है।

      Court का आदेश

      High Court ने अभी final तौर पर proceedings quash नहीं कीं। Court ने माना कि matter को thorough consideration की आवश्यकता है। Opposite Party No. 2 को notice जारी किया गया तथा counter affidavit के लिए तीन सप्ताह और उसके बाद applicants को rejoinder के लिए एक सप्ताह दिया गया।

      सबसे महत्वपूर्ण रूप से, next date of listing तक criminal proceedings पर stay लगा दिया गया, लेकिन यह stay केवल present applicants के संबंध में है।

      ⚖️ मुख्य कानूनी बिंदु

      इस आदेश से यह कहना सही नहीं होगा कि “SC/ST व्यक्ति होने के कारण SC/ST Act कभी नहीं लगेगा।” इस particular case में Court ने prima facie यह महत्वपूर्ण माना कि caste-name abuse का allegation नहीं था और intent of insult missing दिखाई दे रही थी। इसी आधार पर applicants का मामला Keshaw Mahto के ratio से prima facie covered माना गया और proceedings पर अंतरिम रोक लगाई गई।
