🔹 मामले की पृष्ठभूमि
25 अक्टूबर 2022 को K. Rashik अपने भाई के साथ दोपहिया वाहन से जा रहे थे। तिरुपति, आंध्र प्रदेश में एक मिनी ट्रक ने उनके वाहन को टक्कर मार दी। इसके बाद उन्होंने Motor Vehicles Act, 1988 की Section 166 के तहत मुआवजे का दावा Chennai स्थित Motor Accidents Claims Tribunal में दाखिल किया।
Insurance Company ने आपत्ति की कि Chennai Tribunal को territorial jurisdiction नहीं है, क्योंकि दुर्घटना Andhra Pradesh में हुई थी।
🔹 मुख्य कानूनी सवाल
क्या Motor Vehicles Act की Section 166(2) के तहत claimant केवल इस आधार पर Chennai में claim petition दाखिल कर सकता है कि Insurance Company का office Chennai में है?
🔹 सुप्रीम कोर्ट ने क्या कहा?
सुप्रीम कोर्ट ने Section 166(2) की व्याख्या करते हुए कहा कि claimant के पास claim petition दाखिल करने के लिए ये विकल्प हैं:
- जहाँ accident हुआ,
- जहाँ claimant रहता है या business करता है, या
- जहाँ defendant रहता है।
कोर्ट ने विशेष रूप से कहा कि Section 166(2) में defendant के संबंध में “resides” शब्द इस्तेमाल किया गया है, “carries on business” नहीं। इसलिए केवल Insurance Company का किसी स्थान पर business/office होना उस स्थान के Tribunal को अपने-आप territorial jurisdiction नहीं देता।
🔹 Insurance Company की आपत्ति
सुप्रीम कोर्ट ने यह भी स्पष्ट किया कि जब claimant स्वयं Insurance Company को claim petition में party-respondent बनाता है, तो Insurance Company को कानूनन उपलब्ध सभी grounds पर आपत्ति उठाने का अधिकार है, जिसमें territorial jurisdiction की आपत्ति भी शामिल है।
🔹 इस मामले में Court का निष्कर्ष
कोर्ट ने पाया कि:
- claimant का pleaded residence Chittoor, Andhra Pradesh था;
- accident Tirupati District में हुआ;
- claimant ने Chennai में business करने का कोई pleading नहीं किया;
- offending vehicle के driver का residence भी Chittoor District बताया गया;
- इसलिए Chennai में cause of action का कोई हिस्सा नहीं बना।
इसलिए Chennai Tribunal के पास territorial jurisdiction नहीं थी।
⚖️ अंतिम आदेश
सुप्रीम कोर्ट ने Madras High Court के 16.03.2026 के आदेश को बरकरार रखा और claim proceedings को Chennai Tribunal से Chittoor Tribunal transfer करने का निर्देश सही माना। Claim petition को Chittoor Tribunal में कानून के अनुसार expeditiously तय करने का निर्देश दिया गया। Civil Appeal dismissed कर दी गई।
