Complaint seeking departmental action against SHO, Police Station Chhapiya and Investigating Officer in relation to illegal registration and investigation of FIR No. 0221 of 2026.
Detail Complaint is as under

“Sir,

I most respectfully submit as under:

1. That FIR No. 0221 of 2026 dated 26.05.2026 has been registered at Police Station Chhapiya, District Gonda under Sections 115(2), 352 and 351(3) of the Bharatiya Nyaya Sanhita, 2023. The FIR itself reflects that the case has been registered under the aforesaid sections and investigation has been assigned to the Investigating Officer.

2. That as per the First Schedule of the Bharatiya Nagarik Suraksha Sanhita, 2023, Sections 115(2), 352 and 351(3) BNS are non-cognizable and bailable offences triable by any Magistrate.

3. That Section 2(h) of the Bharatiya Nagarik Suraksha Sanhita, 2023 defines a cognizable offence and the offences alleged in the present FIR do not fall within the category of cognizable offences.

4. That Section 174(2) BNSS specifically mandates as follows: “No police officer shall investigate a non-cognizable case without the order of a Magistrate having power to try such case or commit the case for trial.”

5. That despite the clear statutory prohibition contained in Section 174(2) BNSS, the SHO, Police Station Chhapiya, proceeded to register a regular FIR and thereafter entrusted the matter for investigation without obtaining any prior order from the competent Magistrate.

6. That the action of the SHO and Investigating Officer is contrary to the mandatory provisions of BNSS, amounts to abuse of statutory powers and reflects a serious lack of knowledge regarding the basic distinction between cognizable and non-cognizable offences.

7. That registration of a regular FIR and commencement of investigation in a non-cognizable case, without obtaining authorization from the competent Magistrate, is a grave procedural illegality which adversely affects the rights of citizens and undermines the rule of law.

8. That the conduct of the concerned officers warrants immediate administrative and disciplinary scrutiny so that similar illegal actions are not repeated in future.

In view of the above facts, it is most respectfully prayed that:

A. A departmental enquiry/disciplinary proceeding be initiated against the then SHO, Police Station Chhapiya, District Gonda and the concerned Investigating Officer for illegally registering and investigating FIR No. 0221 of 2026 in violation of Section 174(2) BNSS.

B. Both officers be placed under suspension pending enquiry, if found prima facie responsible for the said illegality.

C. The concerned officers be directed to undergo mandatory legal and procedural training regarding the provisions of BNS and BNSS, particularly concerning cognizable and non-cognizable offences.

D. Till successful completion of such training, no investigation work be entrusted to them.

E. Appropriate punishment and adverse service consequences be imposed upon the guilty officers in accordance with law and applicable service rules.

F. Such other action as may be deemed fit and proper in the interest of justice and maintenance of lawful police administration be taken.

6. शिकायतकर्ता के आरोप का विवरण

शिकायतकर्ता अधिवक्ता श्री सज्जाद हुसैन द्वारा प्रार्थना-पत्र प्रस्तुत कर आरोप लगाया गया कि थाना छपिया पर मु०अ०सं०-0221/2026 धारा 115(2), 352 एवं 351(3) भारतीय न्याय संहिता, 2023 के अन्तर्गत प्रथम सूचना रिपोर्ट विधि-विरुद्ध रूप से पंजीकृत कर विवेचना की गई। शिकायतकर्ता का कथन है कि उक्त धाराएँ गैर-संज्ञेय प्रकृति की हैं तथा भारतीय नागरिक सुरक्षा संहिता, 2023 की धारा 174(2) के अनुसार सक्षम मजिस्ट्रेट की अनुमति के बिना विवेचना नहीं की जा सकती थी।

7. आवेदक का बयान

आवेदक द्वारा अपने प्रार्थना-पत्र में वर्णित समस्त आरोपों की पुष्टि करते हुए बताया गया कि मु०अ०सं०-0221/2026 का पंजीकरण एवं विवेचना भारतीय नागरिक सुरक्षा संहिता, 2023 के प्रावधानों के विपरीत की गई है। आवेदक ने संबंधित पुलिस अधिकारियों के विरुद्ध विभागीय कार्यवाही, निलम्बन तथा आवश्यक विधिक कार्यवाही किए जाने की मांग की।

9. जाँच का सारांश / निष्कर्ष

आवेदक श्री सज्जाद हुसैन अधिवक्ता, चैंबर नम्बर-515, ब्लॉक-C, उच्च न्यायालय इलाहाबाद, खण्डपीठ लखनऊ के प्रार्थना-पत्र में अंकित आरोपों की जाँच की गई। जाँच के क्रम में शिकायतकर्ता द्वारा प्रस्तुत प्रार्थना-पत्र, मु०अ०सं०-0221/2026 की प्रथम सूचना रिपोर्ट, मूल तहरीर, केस डायरी, विवेचना अभिलेख, आरोप-पत्र तथा भारतीय न्याय संहिता, 2023 एवं भारतीय नागरिक सुरक्षा संहिता, 2023 के प्रासंगिक विधिक प्रावधानों का परीक्षण किया गया।

अभिलेखों के परीक्षण से ज्ञात हुआ कि दिनांक 26.05.2026 को वादिनी श्रीमती विद्या देवी पत्नी धारीका प्रसाद, निवासी ग्राम घुसवा (खरगूपुर), थाना छपिया, जनपद गोण्डा द्वारा थाना छपिया पर लिखित तहरीर प्रस्तुत की गई थी, जिसमें आरोप लगाया गया था कि दिनांक 25.05.2026 को विपक्षीगण द्वारा गाली-गलौज करते हुए हाथ, लात एवं लाठी-डण्डे से मारपीट की गई तथा जान से मारने की धमकी दी गई।

उक्त तहरीर के आधार पर थाना छपिया पर मु०अ०सं०-0221/2026 धारा 115(2), 352 एवं 351(3) भारतीय न्याय संहिता, 2023 के अन्तर्गत अभियोग पंजीकृत किया गया तथा विवेचना उपनिरीक्षक सुरेश यादव द्वारा संपादित कर उपलब्ध साक्ष्यों के आधार पर आरोप-पत्र प्रेषित किया गया।

जाँच के दौरान शिकायतकर्ता द्वारा यह विधिक आपत्ति उठाई गई कि उपरोक्त धाराएँ भारतीय नागरिक सुरक्षा संहिता, 2023 की प्रथम अनुसूची के अनुसार गैर-संज्ञेय अपराध हैं तथा धारा 174(2) बीएनएसएस के अन्तर्गत सक्षम मजिस्ट्रेट के आदेश के बिना नियमित एफआईआर पंजीकृत कर विवेचना किया जाना विधि-विरुद्ध है।

इस संबंध में उपलब्ध विधिक सामग्री एवं प्रचलित न्यायिक दृष्टांतों का भी परीक्षण किया गया। यह तथ्य संज्ञान में आया कि उत्तर प्रदेश शासन की अधिसूचना संख्या 777/8/94-(2)/87 दिनांक 31.07.1989 द्वारा तत्कालीन धारा 506 भारतीय दण्ड संहिता को उत्तर प्रदेश राज्य में संज्ञेय एवं गैर-जमानती घोषित किया गया था, जिसके संबंध में MATA PRASAD UPADHYAY VS. STATE OF U.P., 1995 (1) JIC 1168 सहित अन्य न्यायिक निर्णयों में भी विचार किया गया है।

तथापि वर्तमान प्रकरण भारतीय न्याय संहिता, 2023 एवं भारतीय नागरिक सुरक्षा संहिता, 2023 के लागू होने के उपरान्त उत्पन्न विधिक व्याख्या से संबंधित विषय है, जिसके संबंध में अंतिम एवं बाध्यकारी निर्णय सक्षम न्यायालय अथवा सक्षम विधिक प्राधिकारी द्वारा ही किया जाना अपेक्षित है।

जाँच में यह भी पाया गया कि अभियोग तत्कालीन उपलब्ध तथ्यों, प्रस्तुत तहरीर एवं उस समय प्रचलित विधिक समझ के आधार पर पंजीकृत किया गया तथा विधिवत विवेचना कर उपलब्ध साक्ष्यों के अनुसार आरोप-पत्र प्रेषित किया गया।

अतः शिकायतकर्ता द्वारा उठाया गया प्रश्न मुख्यतः विधिक व्याख्या एवं प्रक्रियात्मक वैधता से संबंधित है, जिसका अंतिम परीक्षण एवं निर्णय सक्षम न्यायालय अथवा सक्षम विधिक प्राधिकारी के अधिकार क्षेत्र का विषय है। यदि भविष्य में सक्षम न्यायालय अथवा सक्षम प्राधिकारी द्वारा इस संबंध में कोई भिन्न विधिक निष्कर्ष अथवा निर्देश पारित किए जाते हैं, तो उसका अनुपालन नियमानुसार सुनिश्चित किया जायेगा।

Objection on report

That the CrPC 1973 is no more and replace by BNSS 2023, therefore each and every words and judgment of CrPC as well regarding amendment of CrPC is no more in recent judgement of Hon’ble Allahabad High Court, Lucknow in case of Raman Sahni Vs. State of UP in CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 1710 of 2024

–>5.1 The Hon’ble High Court Lucknow in Sahni (supra) held in para 45 to 50 are reproduced as under

“45. Infact, the transfer of property act 1882, which is a central legislation on the subject 'transfer of property other than agricultural land' under the concurrent list, the legislature of State of U.P. had brought an amendment on 30.11.1954, in section 106, whereby, the ‘15 days notice’ period for termination of lease was changed to the ‘30 days’ and as such, section 106 as amended by the State Legislature of U.P., prevailed in the State, but subsequently, parliament substituted section 106 of the transfer of property act 1882 with effect from 31.12.2002 amending the aforesaid provision, completely, thus, question cropped up as to whether the earlier amendment made to section 106 by the U.P. State Legislature with effect from 30.11.1954, would be insignificant on account of the principal of implied repeal.

46. It is culled out from the above-said discussions that when a conflict arises regarding the applicability of provisions of parliamentary law and State law over the same subject matter then, it is apt to say that the power of a legislative body to repeal a law is co-extensive with its power to enact the law and the effect of repealing of the statue, is to obliterate completely from the records of the parliament, as if, it was never in existence. If a lesilature is repealing any act, the same is well within the power to save any right, privilege or remedy provided under the repealed statute. In fact, this balances with the constitutional principle of ‘legislative supremacy’ and ‘coherence.’ Further, the constitutional mandates of cooperative federalism and rule of law is also one of the beacon of light to come to the conclusion regarding the existence and applicability of the law enacted by the parliament and the state legislature.

47. So far as the present matter is that the Cr.P.C. 1973 has been repealed and there is no existence of the Cr.P.C. 1973 and the State amendments made in the erstwhile Cr.P.C. 1973 does not find place in the saving clause of newly enacted Sanhita 2023. This Court is also noticed the stand of the State Government as is said in the counter affidavit that the State of U.P. has proceeded with State amendment regarding the anticipatory bail in Sanhita 2023 and the draft amendment is also prepared, which clearly shows that the State Government is also aware of that after the repealment of the earlier Cr.P.C. 1973, the amendment by way of Act No. 4 of 2019 is not enforceable.

48. In view of the aforesaid submission and discussions, I am of the considered opinion that the subsequent law made by the Parliament though, does not expressly repeal the State law, nevertheless, the State Law will be impliedly repealed and that shall give way to any subsequent parliament law in respect with “same matter” which adds to, amends, varies or repeals the law made by the legislature of the State, by virtue of operation of proviso of Article 254 of the Constitution of India

49. Consequently, the Code of Criminal Procedure (Uttar Pradesh Amendment) Act 2018 (U.P. Act No. 4 of 2019) passed by the State legislature would stand impliedly repealed.

50. Resultantly, the issue no. II framed by this Court is being decided in ‘positive’. Thus, preliminary objection raised by the opposite party is hereby rejected.

Conclusion of law cited above

The Hon'ble Court has held that the CrPC is repealed, by BNSS 2023, all the amendment has also been repeal, there report dt. 30.06.2026 cum order of circle officer Mankapur District Gonda is contrary to the recent decision of the Hon’ble High Court Lucknow in Sahni (supra), is non est and bad in the eye of law, required re-visit (fresh consideration)
